Nietzsche, the Godfather of Fascism? What can Nietzsche have in common with this murderous ideology? Frequently described as the "radical aristocrat" of the spirit, Nietzsche abhorred mass culture and strove to cultivate an Übermensch endowed with exceptional mental qualities. What can such a thinker have in common with the fascistic manipulation of the masses for chauvinistic goals that crushed the autonomy of the individual? The question that lies at the heart of this collection is how Nietzsche came to acquire the (...) deadly "honor" of being considered the philosopher of the Third Reich and whether such claims had any justification. Does it make any sense to hold him in some way responsible for the horrors of Auschwitz? The editors present a range of views that attempt to do justice to the ambiguity and richness of Nietzsche's thought. First-rate contributions by a variety of distinguished philosophers and historians explore in depth Nietzsche's attitudes toward Jews, Judaism, Christianity, anti-Semitism, and National Socialism. They interrogate Nietzsche's writings for fascist and anti-Semitic proclivities and consider how they were read by fascists who claimed Nietzsche as their intellectual godfather. There is much that is disturbingly antiegalitarian and antidemocratic in Nietzsche, and his writings on Jews are open to differing interpretations. Yet his emphasis on individualism and contempt for German nationalism and anti-Semitism put him at stark odds with Nazi ideology. The Nietzsche that emerges here is a tragic prophet of the spiritual vacuum that produced the twentieth century's totalitarian movements, the thinker who best diagnosed the pathologies of fin-de-siècle European culture. This paper outlines an Husserlian, phenomenological account of the first stages of the acquisition of empirical knowledge in light of some aspects of Wilfrid Sellars’ critique of the myth of the given. The account offered accords with Sellars’ in the view that epistemic status is attributed to empirical episodes holistically and within a broader normative context, but disagrees that such holism and normativity are accomplished only within the linguistic and conceptual confines of the space of reasons, and rejects the limitation (...) of the relevant normativity to the cognitive domain. Attention to the phenomenological notion of motivations in our mapping of the structure and acquisition of empirical knowledge reveals a form of weak categoriality given in experience, one outside exclusive mediation by language and concepts but also not merely causal. Section 1 outlines some basic aspects of Sellars’ account of empirical knowledge in Empiricism and the Philosophy of Mind, including a regress objection that arises due to his claim that empirical knowledge presupposes knowledge of general facts about perception. Section 2 examines Sellars’ later revisiting of the objection, via his critique of Roderick Firth, in “The Lever of Archimedes,” focusing on his analysis of the “Myth of the Categorial Given” and his use of the notion of ur-concepts. Section 3 looks at Sellars’ psychological nominalism and his rejection of the explanatory primacy of experience in light of the strict dichotomy between the space of causes and the space of reasons, and shows how Firth’s account aligns with phenomenology in its advocating for an irreducible and non-inferential role for experience. It also raises an important objection to Sellars’ account concerning the categorial givenness of causality. Section 4 turns to Husserl, arguing that his conception of motivation in the Logical Investigations and Ideas II reveals a third explanatory or logical space “between” that of causes and that of reasons. Section 5 further develops this account with regard to the explanatory role of lived experience. Section 6 revisits the regress objection to Sellars from the phenomenological standpoint developed earlier in the paper, and argues that an Husserlian account of empirical knowledge offers a viable alternative to Sellars’ that overcomes the regress objection and gives proper explanatory weight to the evidence of lived experience vis-à-vis scientific presuppositions about causality. This edited volume examines the realizations between theological considerations and natural law theorizing, from Plato to Spinoza.Theological considerations have long had a pronounced role in Catholic natural law theories, but have not been as thoroughly examined from a wider perspective. The contributors to this volume take a more inclusive view of the relation between conceptions of natural law and theistic claims and principles. They do not jointly defend one particular thematic claim, but articulate diverse ways in which natural law has (...) both been understood and related to theistic claims.In addition to exploring Plato and the Stoics, the volume also looks at medieval Jewish thought, the thought of Aquinas, Scotus, and Ockham, and the ways in which Spinoza's thought includes resonances of earlier views and intimations of later developments. Taken as a whole, these essays enlarge the scope of the discussion of natural law through study of how the naturalness of natural law has often been related to theses about the divine. The latter are often crucial elements of natural law theorizing, having an integral role in accounting for the metaethical status and ethical bindingness of natural law. At the same time, the question of the relation between natural law and God-and the relation between natural law and divine command-has been addressed in a multiplicity of ways by key figures throughout the history of natural law theorizing, and these essays accord them the explanatory significance they deserve. In student-led movements, women, minorities, immigrants, and indigenous people demanded that universities adapt to better serve the increasingly heterogeneous public and student bodies. The success of these movements had a profound impact on the intellectual landscape of the twentieth century: out of these efforts were born ethnic studies, women’s studies, (...) and American studies. In _We Demand,_ Roderick A. Ferguson demonstrates that less than fifty years since this pivotal shift in the academy, the university is moving away from “the people” in all their diversity. Today the university is refortifying its commitment to the defense of the status quo off campus and the regulation of students, faculty, and staff on campus. The progressive forms of knowledge that the student-led movements demanded and helped to produce are being attacked on every front. Not only is this a reactionary move against the social advances since the ’60s and ’70s—it is part of the larger threat of anti-intellectualism in the United States. (shrink)

This article discusses the process of empirical research on access to justice, explaining the procedure from data collection to analysis. Research into access to justice finds ways to render civil justice to citizens equitably. Reliable, non-anecdotal data is a prerequisite for useful empirical research into access to justice. Three international initiatives illustrate the reflection of access to justice in research projects. They are, the World Bank's Justice for the Poor Program, UNDP Commission on Legal Empowerment of the Poor, and the (...) Tilburg Microjustice Initiative. The most comprehensive empirical projects on access to justice are those sponsored at the national or sub-national level. Non-governmental drivers of broad-based data collection are other legal actors. This article discusses examples of data collection and evaluation in countries where research has generated data on civil justice. Finally, this article discusses barriers to access to justice, which cause exclusion. (shrink)

This paper argues that the approach to questions of authority, legitimacy, and personal identity characteristic of contemporary European law presents a paradox. The power of the legal project that emerged after the French Revolution lay in its deployment of the notion of abstract legal subjectivity to challenge claimed authority. Much is made of the public law dimensions of this revolutionary moment—the creation of political constitutions establishing national citizenship and human rights standards. But the transposition of abstract legal subjectivity into the (...) private law through national social constitutions like Civil Codes has been far less successful.legal subjectivity in public law regimes necessarily privileges some personal identities over others in its construction of citizenship. These privileged identities of public law citizenship limit how legal subjects can express their identities in the private law. The paper proposes an alternative, pluralist, theorization of the diverse, iterative character of everyday human interaction that gives content to the idea of legal subjectivity in the private law. It seeks to reconcile a public law of abstract, unitary citizenship with a private law of plural legal subjectivities in a manner that advances the project of democratic constitutionalism. (shrink)

Chris L. Firestone and Nathan Jacobs integrate and interpret the work of leading Kant scholars to come to a new and deeper understanding of Kant's difficult book, Religion within the Boundaries of Mere Reason. In this text, Kant's vocabulary and language are especially tortured and convoluted. Readers have often lost sight of the thinker's deep ties to Christianity and questioned the viability of the work as serious philosophy of religion. Firestone and Jacobs provide strong and cogent grounds for (...) taking Kant's religion seriously and defend him against the charges of incoherence. In their reading, Christian essentials are incorporated into the confines of reason, and they argue that Kant establishes a rational religious faith in accord with religious conviction as it is elaborated in his mature philosophy. For readers at all levels, this book articulates a way to ground religion and theology in a fully fledged defense of Religion which is linked to the larger corpus of Kant's philosophical enterprise. In this essay, I examine Philip Clayton’s efforts to construct a philosophical theology that fits the current scientific view of organism. Clayton capitalizes on an evolutionary outlook, which sees organism as an emergent entity composed of lower organic unities, and which, at the highest level of organic development (brain), yields an emergent, non-physical phenomenon (mind). Presuming a bilateral relationship between mind and body, Clayton argues for a picture of God-world relations where world is analogous to body and God is analogous (...) to emergent mind. Contrary to Clayton, I argue that panentheism does not naturally accommodate the current scientific picture of organic development, and as an alternative, I submit St. Augustine of Hippo’s theistic modifications to Plotinian NeoPlatonism. My goal is to demonstrate that Augustine’s metaphysic offers a strong foundation for the construction of a theologically robust and scientifically satisfying philosophy of organism. (shrink)

As conceptual and theoretical discussions on environmental valuation approaches have advanced there is growing interest in the impact that valuation has on decision making. The perceived legitimacy of the outputs of valuation studies is seen as one factor influencing their impact on policy decisions. One element of this is ensuring that participants of valuation processes see the results as legitimate and would be willing to accept decisions based on these findings. Here, we test the perceived legitimacy to participants of two (...) approaches to deliberative monetary valuation, deliberated preferences and Deliberative Democratic Monetary Valuation, in the context of marine planning in the Clyde estuary in Scotland. We compare and contrast deliberated preference and deliberative democratic monetary valuation and track their emergence as responses to critiques of conventional stated preference approaches. We then present the results of our case study where we found that deliberative democratic monetary valuation produced valuations that were perceived as more legitimate that deliberated preference as the basis for decision making by those involved in the valuation process. Wigner's quantum-mechanical classification of particle-types in terms of irreducible representations of the Poincaré group has a classical analogue, which we extend in this paper. We study the compactness properties of the resulting phase spaces at fixed energy, and show that in order for a classical massless particle to be physically sensible, its phase space must feature a classical-particle counterpart of electromagnetic gauge invariance. By examining the connection between massless and massive particles in the massless limit, we also derive a classical-particle (...) version of the Higgs mechanism. (shrink)

Although early-stage finance is critical to the growth of most ventures, it is even more important for social ventures as they face the challenges of balancing their social and commercial objectives. Drawing on institutional logics and signaling theory, this study uses a panel data set of 3,401 nascent social ventures to investigate the important role philanthropic grant funding plays in the organizational and financial development of social ventures. We find mixed results, with positive effects on employment and subsequent access to (...) debt finance, but no effects on revenues and access to equity. Our findings connect these theories by suggesting philanthropic grants provide social ventures with flexibility to invest in human capital without pushing them to pursue short-term financial objectives, and that receiving a philanthropic grant provides a signal that is interpreted differently by debt and equity financiers. These findings are especially relevant as funders increasingly use grants to support social entrepreneurship. (shrink)

Drawing on the empirical premise that attention makes objects look more intense, Ned Block has argued for mental paint, a phenomenal residue that cannot be reduced to what is perceived or represented. If sound, Block's argument would undermine direct realism and representationism, two widely held views about the nature of conscious perception. We argue that Block's argument fails because the empirical premise it is based upon is false. Attending to an object alters its salience, but not its perceived intensity. We (...) also argue that salience should be equated with mental primer, a close cousin of mental paint that reintroduces difficulties for direct realism and representationism. The upshot is that direct realism and representationism are still in trouble, but not for the reason that Block thinks. (shrink)

We address a long-standing debate over whether classical magnetic forces can do work, ultimately answering the question in the affirmative. In detail, we couple a classical particle with intrinsic spin and elementary dipole moments to the electromagnetic field, derive the appropriate generalization of the Lorentz force law, show that the particle's dipole moments must be collinear with its spin axis, and argue that the magnetic field does mechanical work on the particle's elementary magnetic dipole moment. As consistency checks, we calculate (...) the overall system's energy-momentum and angular momentum, and show that their local conservation equations lead to the same force law and therefore the same conclusions about magnetic forces and work. We also compute the system's Belinfante-Rosenfeld energy-momentum tensor. (shrink)

Matteo Ricci (1552-1610) was an Italian Jesuit and one of the first Christian missionaries to China in the modern era. He was a genuine polymath—a translator, cartographer, mathematician, astronomer, and musician. Above all, Ricci was a missionary for the gospel. As we briefly examine his 1603 seminal work, The True Meaning of the Lord of Heaven, our hope is that we, as evangelical educators, will perceive some of the deeper principles necessary for our own missionary work among unreached people.

How should we incorporate algorithms into humanistic scholarship? The typical approach is to clone what humans have done but faster, extrapolating expert insights to landfills of source material. But creative scholars do not clone tradition; instead, they produce readings that challenge closely held understandings. We theorize and then illustrate how to construct bad robots trained to surprise and provoke. These robots aren’t the most human but rather the most alien—not tame but dangerous. We explore the relationship between the reproduction of (...) tradition and the generation of surprise and then show how formalizing a particular humanistic theory as a Bayesian prior allows us to identify readings that disrupt it through a process of algorithmic abduction. Among the exploding universe of surprising (and mostly ridiculous) possible readings, algorithmic efficiency allows us to select readings that nonetheless garner substantial support from the total archive and so merit interpretation and engagement. It is in such interaction between alien and human readers that meaning is made and understanding disturbed; it is by extending alien readings to novel texts that the scholarly community tests the value of those readings. This paper reports laboratory data for games that are played only once. These games span the standard categories: static and dynamic games with complete and incomplete information. For each game, the treasure is a treatment in which behavior conforms nicely to predictions of the Nash equilibrium or relevant refinement. In each case, however, a change in the payoff structure produces a large inconsistency between theoretical predictions and observed behavior. These contradictions are generally consistent with simple intuition based on the interaction (...) of payoff asymmetries and noisy introspection about others’ decisions. (shrink)

Franz Brentano developed an original theory of intrinsic value which he attempted to base on his philosophical psychology. Roderick Chisholm presents here a critical exposition of this theory and its place in Brentano's general philosophical system. He gives a detailed account of Brentano's ontology, showing how Brentano tried to secure objectivity for ethics not through a theory of practical reason, but through his theory of the intentional objects of emotions and desires. Professor Chisholm goes on to develop certain suggestions (...) about intrinsic value made by Brentano and his students, and discusses their relevance to theodicy and the problem of evil. Brentano, as the teacher of Husserl, Meinong, Twardowski, and others, stands at the origin of the phenomenological tradition and of the Polish school of philosophy that developed after World War I. He has also had considerable influence on Anglo-American philosophy. This book will interest those concerned with the origins of phenomenological value theory and more generally with the connections between ethics and philosophical psychology. (shrink)

We suggest that the hierarchical predictive processing account detailed by Clark can be usefully integrated with narrative psychology by situating personal narratives at the top of an individual's knowledge hierarchy. Narrative representations function as high-level generative models that direct our attention and structure our expectations about unfolding events. Implications for integrating scientific and humanistic views of human experience are discussed.

The fearful ape hypothesis proposes that heightened fearfulness in humans is adaptive. However, despite its attractive anthropocentric narrative, the evidence presented for greater fearfulness in humans versus other apes is not sufficient to support this claim. Conceptualization, context, and comparison are strongly lacking in Grossmann's proposal, but are key to understanding variation in the fear response among individuals and species.

Market metaphors have come to dominate discourse on medical practice. In this essay, we revisit Peter Berger and colleagues’ analysis of modernization in their book The Homeless Mind and place that analysis in conversation with Max Weber’s 1917 lecture “Science as a Vocation” to argue that the rise of market metaphors betokens the carry-over to medical practice of various features from the institutions of technological production and bureaucratic administration. We refer to this carry-over as the product presumption. The product presumption (...) foregrounds accidental features of medicine while hiding its essential features. It thereby confounds the public understanding of medicine and impedes the professional achievement of the excellences most central to medical practice. In demonstrating this pattern, we focus on a recent article, “Physicians, Not Conscripts—Conscientious Objection in Health Care,” in which Ronit Stahl and Ezekiel Emanuel decry conscientious refusals by medical practitioners. We demonstrate that Stahl and Emanuel’s argument depends on the product presumption, ignoring and undermining central features of good medicine. We conclude by encouraging conscientious resistance to the product presumption and the language it engenders. (shrink)

Can an action cease to be required of a moral agent solely because it comes too costly ? Can self-sacrifice or risk of self-sacrifice serve as a limit on our moral obligations? Two recent articles in Philosophy , concerned primarily with the possibility of supererogatory action, suggest very different answers to these questions.

In this commentary, we highlight a difficulty for metric navigation arising from recent data with grid and place cells: the integration of piecemeal representations of space in environments with repeated boundaries. Put simply, it is unclear how place and grid cells might provide a global representation of distance when their fields appear to represent repeated boundaries within an environment. One implication of this is that the capacity for spatial inferences may be limited.

Any realist interpretation of quantum theory must grapple with the measurement problem and the status of state-vector collapse. In a no-collapse approach, measurement is typically modeled as a dynamical process involving decoherence. We describe how the minimal modal interpretation closes a gap in this dynamical description, leading to a complete and consistent resolution to the measurement problem and an effective form of state collapse. Our interpretation also provides insight into the indivisible nature of measurement—the fact that you can't stop a (...) measurement part-way through and uncover the underlying 'ontic' dynamics of the system in question. Having discussed the hidden dynamics of a system's ontic state during measurement, we turn to more general forms of open-system dynamics and explore the extent to which the details of the underlying ontic behavior of a system can be described. We construct a space of ontic trajectories and describe obstructions to defining a probability measure on this space. (shrink)

Molecular chaperones in cells constantly monitor and bind to exposed hydrophobicity in newly synthesized proteins and assist them in folding or targeting to cellular membranes for insertion. However, proteins can be misfolded or mistargeted, which often causes hydrophobic amino acids to be exposed to the aqueous cytosol. Again, chaperones recognize exposed hydrophobicity in these proteins to prevent nonspecific interactions and aggregation, which are harmful to cells. The chaperone‐bound misfolded proteins are then decorated with ubiquitin chains denoting them for proteasomal degradation. (...) It remains enigmatic how molecular chaperones can mediate both maturation of nascent proteins and ubiquitination of misfolded proteins solely based on their exposed hydrophobic signals. In this review, we propose a dynamic ubiquitination and deubiquitination model in which ubiquitination of newly synthesized proteins serves as a “fix me” signal for either refolding of soluble proteins or retargeting of membrane proteins with the help of chaperones and deubiquitinases. Such a model would provide additional time for aberrant nascent proteins to fold or route for membrane insertion, thus avoiding excessive protein degradation and saving cellular energy spent on protein synthesis. There has been a growing concern over establishing norms that ensure the ethically acceptable and scientifically sound conduct of clinical trials. Among the leading norms internationally are the World Medical Association's Declaration of Helsinki, guidelines by the Council for International Organizations of Medical Sciences, the International Conference on Harmonization's standards for industry, and the CONSORT group's reporting norms, in addition to the influential U.S. Federal Common Rule, Food and Drug Administration's body of regulations, and information sheets by the Department of (...) Health and Human Services. There are also many norms published at more local levels by official agencies and professional groups.Any account of international standards should cover both scientific and ethical norms at once – the two are conceptually intertwined. Recent sources recognize that “[s]cientifically unsound research on human subjects is unethical in that it exposes research subjects to risks without possible benefit.”. (shrink)
